Nurses who intend to practise independently must be registered with the South African Nursing Council (SANC) and, where relevant, hold the appropriate post-basic qualifications such as Primary Health Care. Independent practice is only permitted within the scope of your registered profession.

Step 2: Business Registration with CIPC

Your medical practice is a business and must be registered with the Companies and Intellectual Property Commission (CIPC). You will also need a tax registration number from SARS and, if your annual revenue exceeds the threshold, VAT registration.

Your location will also determine whether you qualify for certain medical aid network contracting arrangements.

Depending on your specialty, your practice will require specific clinical equipment. For a general practice, this typically includes an examination table, diagnostic instruments, a small treatment area, and appropriate consumables. You will also need reliable practice management software for scheduling, clinical notes, billing, and claims submission. South African options include GoodX, Elixir, and MedEDI, among others.

Step 5: Medical Aid Accreditation

To bill patients' medical aid schemes, you must apply for accreditation with each scheme individually. This includes completing application forms, providing your professional registration details, and agreeing to the scheme's billing rules and tariffs. The process can be time-consuming — begin well before you intend to open your practice. The Council for Medical Schemes (CMS) regulates medical aids in South Africa.

Step 6: POPIA Compliance

The Protection of Personal Information Act (POPIA) applies to all organisations that process personal information, including medical practices. As a healthcare provider, you handle highly sensitive personal and health data. You must have a privacy notice, a data retention policy, and appropriate security measures in place. You must also appoint an Information Officer and notify the Information Regulator if you process special categories of personal information.

Non-compliance with POPIA can result in significant fines and reputational damage. Building POPIA compliance into your practice from day one is far easier than retrofitting it later.
